AstraZeneca and its big drug maker have agreed to settle a US patent dispute over the cholesterol drug Crestor.

The US Food and Drug Administration (FDA) announced it was reviewing the dispute and deciding whether to grant the generic version of the drug, the blockbuster cholesterol-reducing drug, to AstraZeneca.

The FDA rejected AstraZeneca’s request that Crestor be used only for patients with cardiovascular problems that are also related to the use of Crestor, saying the drug is not approved for use in patients with certain kidney disorders, high cholesterol, or an increased risk of stroke or heart attack.

“In our view, this case is too strong for any court to review,” said Dr David Graham, the FDA’s deputy commissioner for medical affairs.

Under the terms of the FDA’s review, AstraZeneca could only use the generic Crestor if the FDA has determined that the drug is not bioequivalent to the branded version.

The FDA has not said whether it would approve a generic version of Crestor for use in patients with kidney disorders. The drug is approved for use in patients with an increased risk of kidney problems.

The drug, marketed as Crestor by AstraZeneca, treats high cholesterol and high blood pressure. It was launched in the US in 2001 under the brand name Crestor.

AstraZeneca has also been in the process of reviewing the FDA’s decision to approve the generic version of the drug.

“The FDA is taking an important step to ensure that the generic, branded and innovative products are appropriately marketed,” said Dr Graham.

“If approved, all three of these medicines will be covered under the same patent, and in the absence of this, it will likely be in the same category as the branded product.”

This decision will allow AstraZeneca to bring the generic Crestor to market in Canada and other countries.

“The FDA will have the expertise to address the complexities of this issue and will work closely with AstraZeneca to ensure that all three of these products are appropriately marketed,” he said.
